in the County of Bucks Gentleman and James Bridgewater of the same place Gentleman All those my three cottages or Dwellinghouses with the appertenances situate at Downley in the Parish of West Wycombe aforesaidnow in the respective occupations of Edmund Keen, Henry Ball and William Hopkins To hold to themtheir heirs executors and administrators Upon the trusts following (that is to say) Upon trust to persist and suffer my dear Wife Mary Bridgewater to receive and take the rents and profits during her natural life to and for her sole use and benefit and to be independent and not subject to the money which shall be by them or him paid for the same or for so much thereof as in such receipt or receipts shall be acknowledged to be received and that no such purchaser or purcahsers after paying his her or their purcahse money to the said Trustee or Trustees or to his or their order shall be answerable or accountable for the misapplication or nonapplication of the same or any part thereof And I hereby Will and devise that the said Joseph White and James Bridgewater or the survivor of them or the heirs executors or administrators of such survivor shall stand and be possessed of and invested in the monies to arise by virtue of such sale or sales of the said last mentioned eleven Cottages Wheeler's Shop and three pieces of Meadow land Upon trust in the first place to pay off and discharge a Mortgage Debt of Five hundred pounds due and owing to Benjamin Wingrove upon security of as portion of the said last mentioned Estate and premises consisting of eleven Cottages or Dwellinghouses Wheeler's Shop and three pieces or parcels of Meadow or Pasture Land and after payment thereof together with all Interest which may be then due thereon and also costs and expenses incident to such sale I give and bequeath the same to be divided unto between and amongst my said four children and the Children of my said deceased Daughter Ellen in like manner and proportion as is directed with respect of the monies to arise by the sale of the Estate and premises firstly hereinbefore bequeathed to my Wife for her life and after her decease to be sold as aforementioned Provided always that if either of the Children of my said deceased Daughter Ellen should happen to die before attaining the age of twenty one years all share or shares and interest under this my Will of such Child so dying shall go to and be equally divided amongst the survivor or survivors of them on their respectively attaining the age of twenty one years Provided also that if any of the Children of my said deceased Daughter Ellen shall not have attained the age of twenty one years at the time of the sale or cenversion into money of the said last mentioned Estate and premises then nit is my Will that my siad Trustees or Trustee for the time being do place the share or shares of such Child or Children under twenty one years of age out at Interest upon Government or real security and apply the Interst appertenances thereunto belonging respectively in the occupations of Richard Ford and Samuel Folly situate at Downley aforesaid also a piece of Garden Ground near the Common Wood now in the occupation of Henry Fox to and for his own sole use and disposal I also give and bequeath unto my Wife Mary the sum of twenty pounds sterling to be paid to her by my said Trustees out of my residuary personal estate within twelve calendar months after my decease I also give and bequeath to my said Wife all the plate now in my Dwellinghouse which she was possessed of in her own right before her marriage with me I give and bequeath unto my Son William James the Hall Clock I give and bequeath unto my Daughter Elizabeth Jane the Kitchen Clock and I give and bequeath unto my daughter Catharine Fox the Secretaire in the Hall and one feather bed All the rest and residue of my Household Goods and furnitures I give and bequeath the same unto the said Joseph White and James Bridgewater upon trust to sell and dispose of the same by Public Auction or Private Contract within twelve calendar months after my decease and the proceeds of the Sale after payment thereout of all expenses attending the same to be equally divided between my Wife my Son William James and my Daughter Elizabeth Jane share and share alike Provided always that if either my said Wife my Son William James or my Daughter Elizabeth Jane should happen to die before the divisio of the proceeds of such last mentioned Sale then the share of such one so dying to go to and be equally divided between the survivor or survivors of them their heirs executors or administrators I also give and bequeath unto the said Joseph White and James Bridgewater All my live and dead Farming Stock Crops of Corn Grain and Hay Money Securities for Money and all other my personal estate whatsoever and wheresoever not hereinbefore disposed of Upon trust to sell and dispose of the same and every part thereof respectively (except ready money and securities for money) as soon as conveniently as might be after my decease and to pay the monies to arise by such Sale (after deducting thereout all reasonable costs and charges in carrying into execution the last mentioned Sale the pecuniary Legacies hereinbefore and hereinafter bequeathed the costs and charges of proving this my Will all my just Debts funeral and testamentary expenses and all other reasonable and legal costs and expenses incurred in or about the execution of the trusts of this my Will) unto between and amongst my said four Children and the Children of my said deceased Daughter Ellen in like manner as is directed with respect to the monies to arise by the Sale of the Estate and premises hereinbefore bequeathed to my Wife for her life and after her decease to be sold as aforesaid Provided always and it is my Will and I direct my said Trustees and the survivor of them and the heirs executors and administrators of such survivor to deduct from the fisrt monies that shall come to his or their hands and payable by virtue of this my Will to the Children of my said deceased Daughter Ellen to deduct thereout the sum of Fifty pounds sterling and out of the monies which shall come to his or their hands for or in respect or on behalf of the said Mary Ann Spriggs to deduct and retain thereout the sum of Forty pounds sterling which said sums of Forty pounds and Fifty pounds I will and direct shall go into and four part of the residuary fund or arising from the Sale of the said live and dead farming stock and effects as aforesaid to be divided between and amongst my said four Children their heirs executors administrators and assigns and the Children of my said deceased Daughter Ellen in the same manner and proportions as is directed with respect to the monies to arise by Sale of the Estate and premises firstly hereinbefore bequeathed to my said Wife for her natural life and after her decease to be sold as aforesaid And I hereby declare that my said trustees and Trustee and the survivor of them shall not be answerable for any more monies than he or they shall actually receive or the one for the other of them although they shall or may join in any receipt or receipts for the sake of conformity and that neither shall be answerable for any Banker Broker or other person with whom any money shall or may be placed out at Interest or for any other matter or thing whatsoever unless the same shall happen by or through his or their own wilful neglect or default And lastly I do hereby nominate constitute and appoint the said Joseph White and James Bridgewater my Trustees and Executors for carrying into execution the trusts of this my Will and to whom I give and bequeath the sum of Two pounds each for their trouble and hereby revoking all former and other Wills heretofore by me made I decalre this to be my last Will and Testament In witness whereof I have hereunto set my hand and seal this twenty sixth day of
