"LATE MR J. GLOYN

(From Our Own Correspondent.) The close of a busy life came when Mr John Gloyn passed away at the residence of his daughter, Mrs W. Sandercock, Carnarvon, on June 16, having reached the great age of 89 years. Born at South Tawton. Devon, deceased came of yeoman stock and maintained the family tradition by spending most of his life in farming pursuits and taking a practical lead in advancing the interests of rural industry. Mr Gloyn was in his youth, a noted athlete and at one time was the champion wrestler of the West of England He married Miss Jane Hodge, and later they made the journey to New Zealand in the ship May Queen, landing at Napier in 1879. Returning to the Homeland in 1893 where they remained for six years, they' later went to Australia for a period, and from there came to Rongotea, arriving here in 1898- Five years were spent here, and then a move was made to Levin, where as a sideline to dairying Mr Gloyn took up onion growing, resulting in a crop of record dimensions and bringing fame to the grower, for the yield of 50 tons to the acre constituted a world's record for that vegetable. However, the Rongotea district was foremost in Mr Gloyn's esteem and ho returned to take up land on Bank's Line in 1903. Each succeeding year demonstrated his skill as a successful and progressive farmer. His influence in public life was exerted in many directions; for years he served as vicar's warden in the Anglican Church; he was a director of the Rongotea Co-op. Dairy Co., and also of the Co-operative Stores; he served 25 years as trustee and was also chairman for a time of the Oroua Drainage Board : he founded the Manawatu Rabbit Board, was a trustee of the Campbclltown Cemetery Trust, for 30 years a member of the Manawatu A. and P. Association and had the distinction of being the first honorary life member of the Farmers Union in the Manawatu. The late Mr IT Hunt and Mr J Gloyn were joint founders of the Rongotea Horticultural Socioty. Among his varied activities Mr Gloyn was an ardent supporter of the National Party. His record in public life was backed by his personal uprightness and strength of character Mrs Gloyn predeceased ber husband bv 30 years. There are left one daughter, Mrs W. Sandercock, and three sons, Messrs John T., William C. (Rongotea), and Arthur J. (Feilding), also 10 grandchildren, and six great-grandchildren. The funeral was very largely attended; service at the home and the graveside were taken by Rev. N. S Barnett and the bearers were Sergt. W J. Gloyn, Private T. Gloyn. Messrs R. O. and J. P. Gloyn (grandsons). R. Brown and Pte. J. Thompson."

The distribution of a deceased father’s estate among a growing family, was the crux of a civil action brought before His Honour Mr Justice Reed at the Palmerston North Supreme Court yesterday, when the children of the late Nathaniel and Rachael Jane Rich proceeded against Stafford W. Rapley, as executor or the latter’s will, and asked for an account of how Mrs Rich had administered her late husband's estate since he died in 1900 without leaving a will. The plaintiffs were; Frederick Brinton Rich, farmer, of Levin; William Philip Rich, farmer, of Otaki; Gertrude Levinia Gloyn. Shannon; Jessie Irene Anderson, Otaki; and Ada Mary Judith Hakaraia, Otaki. Mr Graham appeared for the plaintiffs, and Mr Cooper for defendant. The Claim:. In the statement of claim it was outlined that the plaintiffs were the children of the late Nathaniel Rich, formerly of Otaki, who died on (August 1, 1900, without leaving a will, and his la'te wife Rachael Jane Rich, took possession of the whole estate, amounting to £772 1/4. Rachael Jane Rich died on September 21, 1923, prior to which date she made a will leaving John Knox, Otaki, and the defendant Rapley, executors. Knox had since died. The estate of the late Jane Rich was sworn at £2053 1/3. It was alleged that Rachael Jane Rich as administratrix of - the estate of Nathaniel Rich, was sworn to file a full inventory of the estate, effects and credits of her late husband, on or before November 11. 1900, and a true account of her administratorship on or before August 11, 1901. She had not done this, however, and it was claimed that the plaintiffs, as children of Nathaniel Rich, were entitled to share in the estate, but Rachael Jane Rich had never at any time made any distribution to any of them in respect to their share; neither had she rendered them an account of her administratorship, or any inventory of the estate. On the contrary, it was alleged, she had committed a breach of the trust reposed in her as administratrix by retaining the whole of the assets and using them for her own purposes. It was therefore claimed that an account be taken of all property, moneys, effects and credits in the hands of defendant, as executor of the will of Rachael Jane Rich which formed part of the estate of the late Nathaniel Rich, and that the plaintiffs have judgment for the amounts to which they were entitled. Defence a Denial.
In his statement of defence, the defendant Rapley denied that Rachael Jane Rich had failed to distribute among the persons rightfully entitled thereto, the estate of Nathaniel Rich or any portion of it, or had failed to account to any person entitled, as to her administratorship. He denied also that she had failed to give her children an account of the estate; and also that she had retained or used for her wn or any unauthorised purposes, any assets of the estate. No portion of the estate had been amassed; except such as the testatrix was entitled to use. At the death or Nathaniel Rich, Rachael Jane Rich was left the entire responsibility for the maintenance and up-bringing of the plaintiffs, who were then infants, and any of the assets of the estate which came into her hands were used by her entirely for the purpose of maintaining and providing for herself and the plaintiffs. Children Work the Farm. It was stated in evidence by Gertrude Levinia Gloyn, one of the plaintiffs, that she had frequently asked her mother what had become of her father’s estate, and had invariably received a reply that her mother could look after that alright. Many little troubles eventuated at home through the money, at the recollection of which the witness burst into tears. They had worked hard at home, she said, but in spite of frequent requests, had received none of their father’s estate. William Philip Rich, a brother of the previous witness stated that after his father’s death the children would do the work on the farm while- the mother went to race meetings and other places with a man named Knox, a Maori interpreter. He stated in reply to His Honour that he thought the children could have carried on the farm had the mother died at the same time as the father. In view of the legal aspect of the case, His Honour adjourned the hearing for further consideration by counsel."
