"DIVORCE ACTION.
PUKEKOHE RESIDENTS INVOLVED. An undefended divorce action came before Mr Justice Stringer in the Auckland Supreme Court on Wednesday, when Ellen Hartneady (Mr J. G. Haddow) sought dissolution of her marriage to Michael Hartneady (Mr R. A. Singer) on the ground of desertion.
Petitioner, a boarding-house keeper, said she was married to respondent at Pukekohe in July, 1901, and there were three children of the marriage. In June, 1914, she obtained a separation order against her husband At Pukekohe, and came to Auckland. Since that date she had lived apart from him, with the exception of one occasion in September, 1917, when re-spondent visited her and asked that they should make up their differences as he was going to the front. Petitioner alleged that since Seplember, 1917, respondent had deserted her. Mr Singer, on behalf of the husband, asked that no order be made in respect of the custody of the second child, a girl of 16 years, who was at present living with the mother. A decree nisi, to be made absolute in three months, was granted, and petitioner was given the interim custody of the two younger children."

Before Mr. Justice Cooper and a jury of twelve, Michael Hartneady, a farmer of Pukekohe, on March 21, sought divorce from Ellen Hartneady, a boardinghouse-keeper, residing in Auckland. The ground was adultery, petitioner alleging that a child was born in June, 1918, which petitioner regarded as illegitimate, the parties having been separated by a Magistrate's order in 1914. Mr. Mahony held the towel for the petitioner, whilst Lawyer Haddow was there on behalf of the respondent's interests. Michael said he hitched to Ellen at Pukekohe in 1901, and in due time an olive branch was added to Michael's stock, in the shape of a little girl. Five years later another daughter came to light, but in 1914 he had to admit his wife got a SEPARATION ORDER AGAINST HIM, and he was forced to dub up 25s a week for her maintenance. Respondent went to live at Auckland, and he said he called at her house In Parnell to see the children, but she refused him that paternal right. He did not see his wife again, and it was something of a shock when he heard that in June last Ellen had increased her little family by another. Ellen corroborated the story till the period before 1914, when she avowed Michael was so persistently cruel that she decided to shelve him by judicial separation, arid she achieved this before a magistrate at Pukekohe in March, 1914. She then took her two children and went to live in Auckland, keeping a small boarding house. In the month of September, 1917, Michael reached Auckland and went straight to the petitioner's home, and pleaded to be forgiven, and instead of being refused he was invited inside to the kitchen, where he remarked what fine children his offspring had become. Then he suggested they should make up their differences and he should stop, and respondent listened and forgave him, and they occupied the same room. The next afternoon Michael, promised before departing that he would return at the end of the week. She explained that she had forgiven him because he said he had enlisted and she might never see him again, as a Hun shell, stab, or shot might put him out for ever from the connubial couch. She never saw him after that visit, and the result was the birth in June. The reason she had not written to the petitioner saying, "Unto us a child is born," was because Michael's accomplishments did not Include THE ABILITY TO READ. Two daughters, one sixteen, and the other eleven, vouched for the father's visit in September, 1917, and two male lodgers testified as to the house of respondent being particularly well kept. The jury were only out about ten minutes, and they came back to say that they were of the opinion that respondent had not committed adultery, and that Michael had fathered the child."
